Terms & Conditions

1. Introduction

These Terms of Use (together with our Privacy Policy) govern your use of Origin Student Living’s website and online platforms (“Platform”) and the services offered through them (“Services”). By using this Platform, you agree to these Terms. If you do not agree, you must stop using the Platform.

The Services include browsing our residences, viewing information, submitting applications, billing support, and other features provided online from time to time.

2. Consumer Protection Act Disclosures

As a consumer under the South African Consumer Protection Act, some clauses in these Terms may limit your rights or require acknowledgment. Key clauses include: 4 (Acceptance), 7 (Data Privacy), 8 (Electronic Communications), 12 (Marketing), 13 (Restrictions), 17 (Third-Party Terms), 18 (Warranties), 19 (Indemnities), 24 (Dispute Resolution), and 25 (Disclaimer & Limitation of Liability).

3. Platform and Services

The Platform is owned and operated by Origin Student Living (Pty) Ltd (“Origin”, “we”, “our”, “us”). While we facilitate applications and enquiries, some Services may be delivered by third-party providers (such as payment processors or maintenance contractors).

4. Acceptance

By accessing or using the Platform, you confirm that you accept these Terms. If you are under 18 years old, you warrant that you have the consent of your parent/guardian.

5. Commencement & Duration

These Terms take effect when you first use the Platform and remain binding until terminated under clause 22.

6. Account & Information

To apply or enquire, you may need to provide accurate details (such as name, ID/passport number, contact details, and supporting documents). You are responsible for keeping your information accurate and secure.

7. Data Privacy

We comply with the Protection of Personal Information Act (POPIA). Your personal information will be used only for purposes related to providing Services, including verifying applications, processing payments, or sharing with relevant third-party providers. Full details are set out in our Privacy Policy below (clause 26).

8. Electronic Communications

By using the Platform, you consent to receive communications electronically (e.g. email, SMS, WhatsApp, notices on our site).

9. Use of Platform

You agree to use the Platform only for lawful purposes, and not for activities such as misrepresentation, impersonation, spreading harmful content, hacking, or sending bulk/automated messages.

10. Marketing

We may send you promotional material, offers, and updates about Origin or our partners. You can opt out at any time.

11. Restrictions

You may not share your account with others, attempt to bypass security, or use automated tools to scrape or copy data.

12. Content & Intellectual Property

All content on the Platform (designs, images, text, software, trademarks) belongs to Origin. You may not copy, reproduce, or distribute without written consent.

13. Third-Party Services

Some Services (such as payment gateways or application systems) may be provided by third parties, and your use of them is subject to those providers’ terms.

14. Warranties & Indemnity

You warrant that you will not use the Platform unlawfully. You indemnify Origin and its affiliates against any claims or damages resulting from your misuse of the Platform or Services.

15. Termination

We may suspend or terminate your access immediately if you breach these Terms. You may cancel your use of the Platform by giving 14 days’ written notice.

16. Dispute Resolution

Disputes will be resolved by arbitration under South African law. Johannesburg will be the seat of arbitration. Nothing prevents either party from seeking urgent relief in court.

17. Disclaimer & Limitation of Liability

Use of the Platform and Services is entirely at your own risk. Origin makes no warranties about uninterrupted access or error-free operation. We are not liable for any direct, indirect, incidental, or consequential losses arising from use of the Platform or Services.

Privacy Policy

26.1 Information We Collect
    • Personal details you provide when enquiring or applying (name, contact, ID, proof of registration, funding documents, etc).
    • Application-related documents and messages you submit.
    • Usage data from cookies or analytics.
    • Payment and billing information (processed securely by third-party providers).
26.2 How We Use Your Information
    • To process applications and manage residence placements.
    • To communicate with you about your application, enquiries, or accommodation.
    • To improve our Services and student living experience.
    • To send important updates, notices, or marketing (if you have not opted out).
26.3 Storage & Security

Your personal data is stored securely on servers located in South Africa (and may be backed up in other regions). We use reasonable safeguards to protect against unauthorized access or loss.

26.4 Sharing

We may share your data with:

    • Relevant Origin residences for processing applications.
    • Third-party service providers (e.g. payment processors).
    • Regulatory authorities if required by law.
26.5 Your Rights

You have the right to access, correct, or delete your personal data, and to object to marketing communications. Contact support@originstudentliving.co.za for assistance.

27. General
    • Jurisdiction: South African law applies, and disputes fall under the jurisdiction of South African courts.
    • Changes: We may update these Terms from time to time. Continued use of the Platform means you accept the updated Terms.
